In South Carolina, even if the divorce is uncontested and a marital settlement agreement is reached, both spouses typically attend a final hearing in Court to have the agreement approved by the Court. Some counties allow for virtual hearings. In certain cases, the Courts will allow a divorce with only one party present at the final hearing.
Disputes regarding the division of property, homes, personal property, child custody, child support, spousal support or any other terms of the divorce often result in court intervention. However, court is not automatically required. In some cases, Meihaus Law Firm can help you resolve disputes through negotiation, mediation or arbitration.
